By placing an order with USENV, you agree to the following terms and conditions.

1. Product Information:
a. We strive to provide accurate and detailed product information, including descriptions, specifications, images, and pricing. However, we cannot guarantee the absence of errors or omissions. In the event of a discrepancy, please contact our customer service team for clarification before making a purchase.

2. Ordering Process:
a. When placing an order, please ensure that all required information is provided accurately and completely.
b. By submitting an order, you make an offer to purchase the selected product(s) at the specified price, subject to these Terms of Sale and Return Policy.
c. We reserve the right to accept or decline any order at our discretion.

3. Pricing and Payment:
a. All prices are listed in the applicable currency and are subject to change without notice.
b. The total order amount, including product price(s) and any applicable taxes, shipping, or handling fees, will be displayed during the checkout process.
c. Payment must be made in full at the time of placing the order. We accept payment via all major credit cards, checks, and ACH payments.

4. Order Confirmation:
a. Upon successful submission of your order, we will send an order confirmation email to the provided email address. This email serves as acknowledgment of your order and contains relevant details, including order number, product(s), quantities, and total amount.

5. Shipping and Delivery:
a. We will make reasonable efforts to process and ship your order within the specified timeframe. However, delivery dates are estimates and not guaranteed.
b. Shipping charges, if applicable, will be calculated based on the shipping method chosen during checkout and the destination address.
c. Risk of loss or damage to the products transfers to you upon delivery. Please inspect the package for any visible signs of damage and report any issues to our customer service team within 48 hours.

6. Cancellations and Modifications:
a. Once an order has been placed, it cannot be canceled or modified without prior authorization from our customer service team.
b. We reserve the right to cancel an order if we are unable to fulfill it due to reasons such as unavailability of the product, pricing errors, or suspected fraudulent activity. In such cases, a full refund will be issued within 90 days.

7. Returns and Refunds:
USENV reserves the right to evaluate the returned items to determine if a credit is appropriate. Some items may not be returned once the customer takes delivery. Please see USENV’s return policy for specifics.
Consumable items that are returned sealed, unopened, and unused, will be subject to a 20% restocking fee.
Consumable items that are specially ordered, opened, used, damaged, or cannot be resold, may not be returned for credit.
For purchased instrumentation that is returned, USENV will charge a 20% restocking fee, unless the product is defective.
All returns and exchanges must be in their original condition with all accessories included.
Refunds will be issued within 90 days of receipt and acceptance of the returned product.

8. Limitation of Liability:
a. To the extent permitted by law, U.S. Environmental Rental shall not be liable for any indirect, incidental, consequential, or punitive damages arising from the purchase or use of our products.
b. Our liability for any direct damage shall be limited to the total amount paid by you for the specific product(s) giving rise to the claim.

9. Governing Law and Jurisdiction:
a. These Terms of Sale shall be governed by and construed in accordance with the laws of Massachusetts. Any disputes arising from or in connection with these terms shall be subject to the exclusive jurisdiction of the courts of Massachusetts.

10. Severability:
a. If any provision of these Terms of Sale is deemed invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect.

11. Changes to the Terms:
U.S. Environmental Rental Corp. reserves the right to modify or update these Terms of Sale at any time. The revised terms will be posted on our website, and any changes will be effective.

12. Late Payment Fees; Costs of Collection. Amounts on all invoices more than thirty (30) days overdue will accrue interest at a monthly rate of 3% until paid in full. If USERC agrees to accept a credit card for payment for any past due invoice, a 3% surcharge will be added to the balance of such invoice (including any late interest charges). If USERC has a credit card on file, it will automatically charge the credit card at 45 days and will include the 3% surcharge.
